Policy / Restriction

1) Under no circumstances may a reservation or space be sold, sublet, assigned or transferred to another individual.  Any vendor violating this rule will be barred from obtaining further reservations or spaces at the Santa Fe Springs Swap Meet.
2) No soliciting or distributing of any advertising or marketing material without prior approval of management.
3) No pets or animals are allowed on the premises.
4) Space is assigned solely for the display and sale of merchandise or services approved by the management.  The Santa Fe Springs Swap Meet also reserves the right at its discretion to prohibit the sale or display of any item or display of any item or service. Items prohibited include, but are not limited to, the following:
  a.  No food, gum, candy, drinks, or other things which may be used for human consumption (except approved fruits, vegetables and other food items for off-site consumption) will be allowed.  See management for approval of items.
  b.  No entertainment or games to be played by the public without prior approval of management.
  c.   No guns, fireworks, or ammunition of any kind will be allowed.
  d.   No hash or water pipes, roach clips, or other paraphernalia commonly used or associated with the use of marijuana, or other forms of dangerous drugs or narcotics will be allowed.
  e.   No endangered species products of any description will be allowed.
  f.   No items which are illegal or pornographic will be allowed. 
  g.   No items which may constitute patent, trademark or copyright infringement and no counterfeit products, nor any items involving a misrepresentation and warranty, trademark, patent, or copyright infringement of any type will be allowed.  If any vendor is found to be in violation of this rule, he/she shall indemnify and hold harmless the Santa Fe Springs Swap Meet from any damages, expenses, or costs which they may incur as a result of a vendor violating this rule.
  h.   No adult magazines (such as Playboy, Playgirl, Penthouse, Hustler, etc.), adult video tapes, or adult DVDs which depict or portray persons in the nude can be conspicuously displayed. 
  i.   No other item which in the opinion of the management may be hazardous to the health and/or welfare of the vendors and/or other persons on the premises of the Santa Fe Springs Swap Meet will be allowed.
  j.   There will be no palm reading.
  k.   There will be no motor vehicle sales permitted.
  l.   There will be no ear piercing allowed.
  m.   The sale of personal health services will not be allowed.
  n.   The sale of dogs and cats will not be allowed.
5) All vendor spaces are clearly marked with yellow or white painted boundary lines. Vendors must conduct all business and display all merchandise within the confines of the said boundaries.
6) No refunds will be issued for any reason.
7) Vendors should have all appropriate documentation (resale license, admission/container card, valid ID, automobile liability insurance, etc.) ready when entering the field.  Vendor’s selling license must be conspicuously displayed at all times.
8) By purchasing this license, the vendor agrees to relieve the Santa Fe Springs Swap Meet of any liability for bodily injury or damage to merchandise or property that may arise in connection with the vendor’s use of this space or that may arise in connection with the vendor’s activities at the swap meet, and the vendor agrees to defend, indemnify and hold the Santa Fe Springs Swap Meet harmless against any claims or lawsuits that may be brought because of injuries suffered or damage caused by or in connection with the vendor’s activities at the swap meet.
9) Each space shall be kept clean at all times and all vendors must take their trash and sale merchandise with them when they leave.  The trash boxes in the aisles are for customers’ use only.  If a vendor’s space is found to be dirty because of trash or merchandise left behind, a minimum cleanup charge of $10.00 per space will be assessed to the vendor and future space assignments to vendors may be terminated or denied.
10) Each vendor must vacate his/her selling area by 8:00 p.m. Saturday & Sunday and by 12:00 a.m. Friday.
11) Sales Tax: California Retail Permit/Business License:
  a.   Any person desiring to engage in the sale of taxable merchandise at the Santa Fe Springs Swap Meet must hold a valid California State Board of Equalization Resale Permit.  Certain types of merchandise, such as a fresh produce, vegetables, and other food products sold for consumption off the premises are at present exempt from sales tax and vendors are not required to hold a permit.  Other exceptions are professional services and used “garage sale” type items sold once a year.  Persons selling garage sale type items on a regular basis must obtain a permit.  If a vendor has any questions regarding whether a permit is required, he/she should call his/her local State Board of Equalization office in L.A. County.  Management assumes no responsibility for notification to vendor of any change in Sales Tax Laws.
  b.   All vendors are asked to designate their business address as 13963 Alondra Blvd., Santa Fe Springs, CA 90670 on the Resale Permit issued by the State Board of Equalization.  (Since vendors cannot receive mail at this address, he/she must also list his/her mailing address with the State Board.)
  c.   All vendor’s reservations must be in personal name of the individual vendor whose name is issued (not a business name).  In the case of partnership, all names must appear on the reservation card.
  d.  The California State Board of Equalization Resale Permit must be kept in vendor’s possession at all times at the Santa Fe Springs Swap Meet and be presented for inspection by the State Board or law enforcement personnel on demand.
  e.   Vendors who do not obtain a Resale Permit from the State Board will be refused space assignments for the sale of taxable merchandise until such time as a permit is obtained.
  f.  At present, no city business license is required; all vendors are covered under the Santa Fe Springs Swap Meet license.
12) Vendors shall engage in prudent customer relations and customary business practices in the sale of all merchandise, including but not limited to, exchanging items or providing refunds in the event of the sale of goods which are damaged or defective.
13) The Santa Fe Springs Swap Meet is not responsible for lost, damaged, or stolen articles.
14) Operating rules, including fees, terms, and conditions, are subject to change without notice.  Vendor agrees to comply with all such changes.  Vendor should consult with the business office at (562) 921-4359 extension 0 regarding any changes.  It is the responsibility of the vendor to obtain a current copy of these Rules and Regulations.
15) Vendors must fully cooperate with fellow vendors and all employees of the Santa Fe Springs Swap Meet.  Customers must be treated with courtesy and fairness when conducting business on these premises.  Failure to strictly comply with these Rules and Regulations will result in immediate removal of a vendor and his/her product, by tow truck and police escort if necessary.
16) Electrical cords strung across the aisleway are prohibited.
17) Vendors use of poles to support an overhead awning in their space must have the base of the supports imbedded in concrete.  This should aid in preventing the awnings from being blown into an individual causing injury.  Should you be utilizing another technique in securing your awning, please contact the office for approval.  Any vendor refusing to comply with this request will not be allowed to erect the awning.
18) Your employees can come in with you free of charge.  If they come in by themselves, they will be charged admission.
19) Electrical outlets on the grounds are provided to assist vendors in the sale of their merchandise.  No outlets will be used to supply electrical current to mobile homes or campers.  Any vendors abusing electrical use will be barred from the Santa Fe Springs Swap Meet.
20) Automobile liability insurance must be presented before driving inside the swap meet.
21) If any legal action, including an action for declaratory relief, is brought to enforce the provisions of this agreement the prevailing party shall be entitled to recover reasonable attorney’s fees from the other party.  These fees, which may be set by the court in the same action or in a separate action brought for that purpose, are in addition to any other relief to which the prevailing party may be entitled.  This provision applies to the entire agreement.
22) Vendor hereby releases and discharges Swap Meet and newport Diversified, Inc., and each of their owners, operators, officers, directors, and employees, and the owner and operator of the facility where the Swap Meet is held (hereinafter referred to as the "Releasees") from, and waives all claims against and covenants not to sue Releasees for, any and all liability to Vendor and Vendor's personal representatives, guardians, conservators, assigns, heirs and next of kin for any and all claims, damages, harm, injuries or losses suffered because of bolidy or personal injury or property damage or losss, whether caused by any negligent or grossly negligent act or omission of any of the Releasees or otherwise when Vendor is participating in any activity at the Swap meet facility, using any Swap meet facility or in connection with the Swap Meet in any way.
23) "Vendor" as used in these Rules & Regulations shall include the Vendor, its/his/her agents and employees, family members, helpers, delivery persons and any other person on the Santa Fe Springs Swap meet property at the request of the Vendor to work with or assist the Vendor
